Draft GTC for BlendSprint, a Swiss sole proprietorship with a Shopify store, dropshipping model, and deliveries to Switzerland, Germany, and Austria.

1. Provider

2. Scope

These General Terms and Conditions apply to all orders, deliveries and services via the BlendSprint online shop at www.blendsprint.ch.

The offer is aimed at customers in Switzerland, Germany and Austria. For customers from Germany and Austria, mandatory consumer protection regulations of their country of residence remain unaffected.

3. Products

BlendSprint primarily sells portable blenders, drinking bottles, kitchen products and fitness products.

Product images, colors, sizes and representations may differ slightly from the delivered product depending on the screen, lighting conditions or production batch. Technical specifications are made to the best of our knowledge and may vary slightly depending on the product variant.

4. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order. By submitting the order, the customer makes a binding offer to purchase the products contained in the shopping cart.

The contract is concluded as soon as BlendSprint confirms the order by email or ships the goods. BlendSprint may reject or cancel orders, particularly in the event of obvious pricing errors, delivery problems, suspected fraud or unsuccessful payment.

5. Prices

All prices are displayed in Swiss Francs (CHF) in the shop, unless otherwise explicitly stated. Shipping costs, discounts and other price components are displayed at checkout.

For deliveries outside Switzerland, import duties, taxes, customs or processing fees may arise depending on the destination country, unless these are already shown at checkout or covered by BlendSprint. Customers are responsible for observing the import and tax regulations applicable to their destination country.

6. Payment

Payment is made via the payment methods offered in the Shopify checkout. Depending on availability, the following payment methods may be offered in particular:

• Klarna

For individual payment methods, additional terms and conditions of the respective payment service provider may apply. BlendSprint generally does not receive full credit card data for card payments.

7. Delivery & Dropshipping

BlendSprint works with external suppliers and fulfillment partners, including CJ Dropshipping, AliExpress or comparable providers. The goods can be shipped directly from a partner warehouse to the customer.

The average delivery time is usually 5 to 10 days. The maximum delivery time is currently stated as 15 days, unless otherwise specified on the product page or at checkout.

Express shipping is currently not offered. For bundle offers, free shipping may be granted if this is displayed accordingly in the shop or checkout.

Delivery delays due to customs, transport service providers, holidays, force majeure, incorrect address details or circumstances beyond BlendSprint's control may occur.

8. Returns & Withdrawal

8.1 Switzerland

For customers with a delivery address in Switzerland, BlendSprint voluntarily offers a return option of 4 days from receipt of the goods. The goods must be unused, clean, undamaged and complete. The customer bears the costs of the return, unless there is a defect.

8.2 Germany and Austria

For consumers with a delivery address in Germany or Austria, the statutory right of withdrawal of 14 days applies. Details can be found in the separate withdrawal instructions for EU customers.

8.3 Return Process

Before any return, BlendSprint must be contacted by email at info@blendsprint.ch. Returns without prior contact cannot be clearly assigned.

9. Defects & Faults

If a product is damaged, faulty or incomplete upon receipt, the customer should contact BlendSprint as soon as possible by email. For quick processing, photos, videos, order number, packaging images and a brief description of the problem may be requested.

After examination, BlendSprint may offer a replacement, subsequent delivery, refund or other appropriate solution, depending on the case. Damage caused by improper use, dropping, water damage to the motor unit, unauthorized repair or normal wear and tear are excluded, to the extent legally permissible.

10. Warranty

If a manufacturer's warranty exists for individual products, the warranty conditions of the respective manufacturer apply. Statutory rights regarding defects remain unaffected.

11. Product Safety and Proper Use

Products are to be used in accordance with the operating instructions and product description. Portable blenders are not suitable for hot liquids, hard objects outside of the intended application, or complete submersion of the motor unit, unless the product description explicitly states otherwise.

Children may only use electrical kitchen products under supervision. Customers are obliged to observe safety, charging, and care instructions.

12. Retention of Title

The delivered goods remain the property of BlendSprint until full payment has been made.

13. Liability

BlendSprint is only liable for direct damages caused by willful intent or gross negligence, to the extent legally permissible. Liability for indirect damages, consequential damages, loss of profit, data loss or damages caused by improper use is excluded, to the extent legally permissible.

Mandatory statutory liability provisions, in particular for personal injury or product liability, remain unaffected.

14. Data Protection

Information on the processing of personal data is contained in BlendSprint's separate privacy policy.

15. Applicable Law and Place of Jurisdiction

Swiss law applies, excluding conflict of law provisions, unless mandatory consumer protection regulations dictate otherwise.

The place of jurisdiction is, to the extent legally permissible, the registered office of BlendSprint or the domicile or business address of the owner. For consumers from Germany and Austria, mandatory places of jurisdiction and consumer rights remain unaffected.

16. Final Provisions

Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions remains unaffected. BlendSprint may adjust these GTC as required. For orders already placed, the version valid at the time of the order applies.
